User Terms of Service

Introduction
www.UniqueServers.com is published and operated by Unique Servers, LLC; as such, any first-person pronouns used in this policy such as "we", "our", and "us" refer to Unique Servers LLC. You, as the user of our services, shall be referred to in this policy by applicable second-person pronouns such as "you" and "yours".
By using our services, you agree to the following terms:
Modifications Of Our Terms Of Service
We fully reserve the right to modify our Terms of Service and any of our other policies and agreements at any time and in any manner. Changes to our Terms of Service will be posted here and all users will be notified through an email sent to their respective registered email addresses in our system in the event of said change. It is your responsibility to ensure that you check your email for notifications of such updates and to read and understand the updates to our Terms of Service. As noted at the top of this document, “Last Modified:” indicates the last date upon which our Terms of Service have been modified; the modified version supersedes any prior versions immediately upon posting.
Age Of Restriction
You affirm you are at least 13 years of age and that you have the legal capacity to enter into a legal agreement as set forth. If you are not at least 13 years of age, you may not use or access any service offered by Unique Servers. Teenagers, ages 13 to 17 must have the permission of a parent or legal guardian to access and use our services. We do not assume any responsibility or liability for any misrepresentations regarding a user’s age.
Limitation Of Liability And Indemnity
In no event shall we or our service providers be liable to you or any other third party for any direct or indirect damages incurred through use of our services. You agree to indemnify and hold harmless Unique Servers, LLC and all employees and agents associated against any losses, claims, damages, or any other liabilities.
Links
Some websites linked to us are owned and operated by third parties; as such, we have no control over their policies or content. You acknowledge that we are not liable for any third party content and we do not monitor their content. You also agree to not hold us liable should any damages be incurred through use of any third parties linked to us. All access to third party content is done at your own risk.
Payments
All payments must be made before any services will be rendered to you, the user. Service payments must be made on or before the next billing date. In the event that payment is not made when due, you will be notified and your services will be suspended for up to three days before termination for nonpayment.
Cancellation
You may cancel your services at any time; however requests to cancel service must be received no later than 48 hours before the next payment due date in order to avoid additional service charges. Services canceled will continue to function until the current billing period ends.
Refunds
New users are eligible for a refund within 72 hours of service activation if they are not satisfied with their service. Existing users are only eligible for a refund in the event that we do not maintain 95% hardware or network uptime over a 30 day period due to no fault of the user. Otherwise, all payments made to Unique Servers are non-refundable.
Server Upkeep
You are responsible for the management and upkeep of your server. In the event of server downtime, please contact support to have the issue resolved; however we are not responsible for any downtime of your server due to misconfiguration by you.
Server Modifications
You are allowed to modify your server any way you see fit with the exception of the following:
You may not install any modifications that modify the number of slots, tickrates, or FPS settings.
You may not install modifications which use excessive resources that may disrupt the services of other users. We will notify you ahead of time if your server resource usage is unusually high.
You may not install any modifications considered illegal such as those used to run 'cracked' servers.
Advertisement
You may not configure your server in any way that advertises services from another Game Server Provider.
Server Inspection
We reserve the right to monitor and inspect your servers to ensure that you are in compliance with the terms of service.
FTP Use
You may not use FTP for file storing and you are responsible for all files stored within your server's folder. Only files related to the server itself may be uploaded. In the event that any malicious files are uploaded with the intent to disrupt services, legal action will be taken.
Private Servers
You may not remove the password from your private server at any time. Doing so will result in suspension of services.
Failure To Comply
If at any time you are found to be in violation of our terms of service, warnings and suspensions may be issued. In the event that multiple violations occur, your services may be terminated without warning.
